Holiday Package Bidding Event T&Cs

1. Introduction

The Event will be hosted by its franchisee (collectively referred to as "Franchisees") at DLF Galleria Market, Phase 4, Gurgaon [“Event Location”] on 22nd December 2024.

2. Eligibility & Registration

The Event is open solely to individuals residing in the designated target location (wherein the physical auction process will take place) who have attained the age of majority (eighteen years) at the time of the Event. By participating in the Event, you, the Bidder, acknowledge and agree to be bound by these T&Cs. To participate in the bidding process, Bidders must register through the designated microsite accessible by scanning a QR code at the Event Location. Registration for the Event and participation in the bidding process are free of charge and open to the general public.

4. Bidding Process

A total of nine (9) distinct holiday packages (collectively, the "Packages") will be offered for bidding. A complete list of the Packages is annexed hereto as Annexure A of the T&Cs. Bidding for each package will commence at a base price of one rupee (₹1) and will continue until a winner is determined. Bids may be submitted either through the microsite or at the designated physical Event Location. The Organizer reserves the unilateral right to modify the bidding process at any time. Winning Bidders will be assisted by the Franchisees with package booking and payment collection and processing. All inquiries and concerns relating to the booked package must be directed solely to the facilitating Franchisee.

5. Determining the Winning Bidder

The successful Bidder for each Package will be the participant who submits the highest valid bid at the conclusion of the designated bidding period for that Package. In the event of a tie, the first bid placed at the highest amount will be deemed the winning bid. The Organizer's decision on the winner will be final and binding.

6. Booking and Payment

Winning bidders for each Package will be assisted and facilitated by the concerned MMT Franchisee which has facilitated the Bidding process for the bidders at the Event, and in booking the respective Package. The final purchase price for the Package will be equivalent to the winning bid amount. Full payment for the Package must be rendered at the time of booking using the accepted payment methods designated by the Franchisee. PLEASE NOTE THAT THE PACKAGE PRICE IS APPLICABLE FOR COUPLE BOOKINGS ONLY. The price shared per person is based on double occupancy. Adding additional passengers will incur charges based on the original price, not the winning bid price. Any modifications or additions to the Package components (flights, hotels, or activities) will result in additional charges based on the difference in cost. The bidder undertakes to communicate to the Organiser and/or the MMT's Franchisee, the final departure date, at least one (1) month prior to the desired departure date, failing which the package shall incur additional charges as per actuals rate of the Package (i.e, price differential to be paid by bidder)

7. Unsuccessful Bidders' Reward

All registered Bidders who do not emerge as winning Bidders will be eligible to receive a reward in the form of MMT Holidays Gift Card with a value of Two Thousand Five Hundred Rupees (₹2,500). The MMT Holidays Gift Card shall be subject to its own separate terms and conditions. Details concerning the Gift Card will be communicated to unsuccessful Bidders following the conclusion of the Event

9. Microsite Disclaimer

The Organizer shall not bear any liability for technical malfunctions of the microsite that may impede registration or bid submission. The Organizer reserve the right to modify the features and functionalities of the microsite at any time.

10. Disclaimer of Liability

The Organizer provide no express or implied warranties with respect to the Packages offered during the Event. The Organizers shall not be held responsible for any modifications or cancellations to the Packages subsequent to the Event. Furthermore, the Organizers shall not be liable for any losses or damages arising out of participation of the bidders in the Event. This includes, but is not limited to, disruptions in travel arrangements, issues concerning accommodation, or personal injuries.

11. Governing Law and Dispute Resolution

These T&Cs shall be governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these T&Cs or the Event shall be subject to the exclusive jurisdiction of the courts located in Gurugram, Haryana, India.

12. Limitation of Liability

MakeMyTrip shall not be liable for any indirect, punitive, special, incidental, or consequential damages arising out of or in connection with the purchase or use of airport services.

13. Force Majeure

The Organizer shall not be held responsible for any delay or failure arising from or is in connection with an act of god or other event which is beyond our reasonable control, including without limitation war, hostilities, civil commotion, strikes, lockouts, pandemics, natural calamities, industrial disputes or laws, governmental regulations/notifications.

14. Right to Modify T&Cs

The Organizer reserves the right to modify these T&Cs at any time without prior notice. The updated T&Cs will be posted on the microsite and at the Event location.

15. General Terms

All other terms and conditions as listed in the User Agreement and Privacy Policy of MakeMyTrip will be applicable to Event. Bidders and/or the users acknowledge and agree to abide by all applicable laws, regulations, and guidelines governing the Event and their participation.

16. Interpretation of Terms

MakeMyTrip is the sole authority for interpretation of these terms and conditions. Any ambiguity or dispute regarding the interpretation of terms shall be resolved in favor of MakeMyTrip.
